1. Agreement Overview
These Terms & Conditions (the “Terms”) form the agreement between you and OXFORD FOREIGN CURRENCY EXCHANGE PTY LTD (ABN 65 604 017 478), trading as “OXFORD FOREX” (“O&F”, “us”, “we”, or “our”).
- Acceptance: By using our Services, you agree to these Terms. If you do not accept them, you are not permitted to use our Services.
- Language: These Terms are provided in English.
- Modifications: We may update these Terms periodically. The version current at the time of your Transaction will apply to that specific Transaction.
2. Definitions
Unless the context requires otherwise, the following definitions apply:
Parties Involved
- Customer (“you”): The individual or entity initiating a currency exchange.
- O&F: Oxford Foreign Currency Exchange Pty Ltd (Oxford Forex).
- Service Provider: A third party that assists O&F in delivering the Services (e,g Australia Post).
Transaction Details
- Services: Foreign currency exchange conducted in-branch or online.
- Transaction: Any access, use, or attempted use of our Services.
- Account Details/Registration: Your personal information registered with us (online or in-branch).
- Exchange Rate: The specific rate applied to your Transaction.
- Delivery Method: How the funds are received (e.g., via post, or cash pickup).
- Payment Method: The way you pay O&F for the Service.
Fees and Amounts
- Transaction Amount: The base amount of money exchanged.
- Service Fees: Fees for providing the Service (e.g., transaction fees).
- Charges: Additional costs such as card surcharges, cancellation fees, or admin fees for fund recovery.
- Total Amount: The sum of the Transaction Amount plus all Service Fees.
- Payout Amount: The final amount received by the Customer.
Offers
- Promotion: A broad offer or deal applicable to a group of customers.
- Voucher/Coupon: A unique offer code tailored to a specific designated Customer.
3. Legal and General Terms
- Governing Law: This agreement is governed by the laws of New South Wales, Australia. You submit to the jurisdiction of the courts of NSW.
- Entire Agreement: These Terms constitute the entire agreement between you and O&F, superseding all prior communications.
- Severability: If any part of these Terms is found to be unenforceable, that specific part is severed, and the remainder of the Terms remain valid.
- No Waiver: A failure to enforce a right does not mean O&F has waived that right. Any waiver must be in writing and signed by us.
- O&F Discretion: Any consent required from O&F under these Terms may be withheld at our absolute discretion.
3.1 Regulatory Compliance

AML/CTF Obligations: In accordance with the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), O&F is legally required to monitor transactions and report certain activity to the Australian Transaction Reports and Analysis Centre (AUSTRAC).

Mandatory Disclosure: You acknowledge and agree that we may be required to disclose your personal information, transaction history, and identification details to AUSTRAC and other relevant law enforcement or government authorities without notice to you.

ASIC Registration: O&F is a registered entity with the Australian Securities and Investments Commission (ASIC) and operates in strict accordance with Australian financial services regulations.

Reporting Requirements: We reserve the right to delay, block, or cancel any transaction where we suspect it may breach Australian law or our internal compliance policies. O&F shall not be liable for any losses arising from such delays or cancellations made in connection with our regulatory duties.
4. Eligibility and Use of Services
- Minimum Age and Residency: To use our Services, you must be at least 18 years old, reside in or be travelling in Australia, and possess the legal capacity to enter into a binding contract.
- Accuracy of Information: You are responsible for ensuring all Transaction details are accurate before submission. Once submitted, details generally cannot be changed.
- Prohibited Conduct: You must not use any software or device to interfere with the operation of our Services. You are prohibited from using the Services for fraudulent, illegal, or unethical activities, including money laundering or terrorism financing.
5. Exchange Rates and Payment
- Quotes: Exchange Rate quotes are only valid at the exact time they are provided and are subject to market fluctuations. A rate is only confirmed once you receive a Booking Confirmation and O&F receives your full payment within the specified timeframe.
- Variable Rates: O&F may apply different rates across different channels (in-branch vs. online) based on operational costs, promotions, or market competition.
- Surcharges: * A non-refundable surcharge applies to credit card payments (unless a transaction is cancelled due to O&F’s fault).
- O&F is not responsible for external bank fees, such as “cash advance” interest or overdraft fees resulting from your chosen Payment Method.
- Reimbursement: You agree to reimburse O&F for any charges we incur resulting from your Transaction, such as credit card chargebacks.
6. Information, Documentation and Identity
- Verification: True and complete identification, supporting documents, and contact details (email and phone) that you personally own and access.
- Electronic Verification Consent: You consent to O&F disclosing your personal information (name, address, DOB) to electronic identity verification providers to verify your identity.
- Privacy: Your data is handled per our Privacy Policy, which includes the use of CCTV and audio recording at our premises or via telephone.
7. Breach and Cancellation
- Suspension of Service: If O&F reasonably believes you are involved in illegal or unethical activity, or have breached these Terms, we may:
- Cancel the transaction and cease all dealings with you.
- Report the matter to the relevant authorities (e.g., AUSTRAC or Police).
- Cancellation Fees: If we suspend your registration or cancel a transaction due to a breach, we are entitled to deduct a reasonable administration/cancellation fee from any refund.
- No Professional Advice: Information provided by O&F does not constitute legal or financial advice. You should consult your own professional advisers regarding the legal effects of using these Services.
8. Transaction Cancellation & Refusal
8.1 O&F’s Right to Refuse or Cancel
O&F reserves the right, at its absolute discretion, to refuse, suspend, or cancel any Transaction or Service at any time. We are not required to disclose the reasons for such a refusal or cancellation. Specifically, we may cancel a Transaction if:
- Pricing & System Errors: An incorrect Exchange Rate or fee was displayed (due to internal or external technical errors) that deviates significantly from the prevailing market rate.
- Payment Failures: Full payment is not received within the required timeframe or is made via an unauthorised method (e.g., Prepaid/Gift cards or unverified third-party accounts).
- Identity & Compliance: We are unable to verify your identity, or if you fail to comply with requests for supporting documentation.
- Security & Regulatory Risk: We suspect fraudulent, illegal, or unethical activity, or if any party to the transaction appears on a government-mandated prohibited/restricted list.
8.2 Customer Cancellation
To the extent permitted by law, you do not have an automatic right to cancel a Transaction once it has been received by O&F.
9. Liability & Refunds
9.1 Service Warranty
We warrant that our Services will be provided with due care and skill. Our sole liability for a breach of this warranty is limited to, at our option:
- Performing the Service again; or
- Refunding the relevant Service Fees.
9.2 Refund Requests & Processing
- Notification: You must notify us of any unauthorised or incorrectly executed Transaction without delay via the contact details provided in these Terms.
- Method: Approved refunds will be processed on the same business day. To prevent fraud, refunds will only be credited to the original payment source (bank account or card) and in the original currency used for the Transaction.
- Timeframes: While we process refunds promptly, it may take 1–5 business days for funds to appear in your account, depending on your financial institution’s processing times.
10. Account Closure & Data Retention
- Closing Your Account: You may request to close your account by contacting us. We will action such requests within 1–5 business days.
- Regulatory Obligations: Notwithstanding an account closure, O&F is legally required to retain certain records and personal information for a mandatory period under Australian law.
- Access After Closure: Once closed, you will lose access to our online and in-branch Services. However, you may contact us to request copies of your historical Transaction statements.
- Reactivation: Reactivating a closed account requires a formal request and identity verification at one of our branches.
11. Electronic Communications
11.1 Consent to Electronic Delivery
You consent to receive all “Communications” (including these Terms, amendments, Transaction records, and legal notices) electronically. This consent remains valid unless you withdraw it in writing.
11.2 Requirements & Responsibilities
- Technical Standards: You are responsible for maintaining the hardware (smartphone/computer), software (email and browser), and internet connectivity required to access and store these Communications.
- Updating Details: You must notify us immediately of any change to your email address or contact number. We will perform identity verification before updating your registration profile.
- Withdrawal of Consent: If you withdraw your consent for electronic communications, we reserve the right to contact you via other means solely to fulfil existing Transaction obligations.
12. System Availability and Maintenance
- Scheduled Maintenance: O&F will provide advance notice for significant system maintenance (defined as a period exceeding 6 hours) that may interrupt access to our online platform.
- Third-Party Providers: (Exchange rate API) We are not responsible for the maintenance schedules or system outages of our Service Providers. You acknowledge that maintenance performed by these providers may result in processing delays for your Transaction requests.
13. Promotions, Vouchers, and Coupons
13.1 General Provisions
- Time Zone: All dates and times regarding promotions, vouchers, or events are based on Sydney, Australia (AEST/AEDT).
- Expiration: Offers automatically expire after the specified end date and cannot be reinstated.
- Specific Terms: Additional terms may apply to specific offers and will be detailed at the point of promotion. Participation in any offer constitutes acceptance of both these general Terms and any specific offer conditions.
13.2 Promotions
- Availability: Promotions are subject to availability and may be modified or terminated by O&F at any time without prior notice.
- Combinability: Unless otherwise stated, promotions cannot be combined with any other offers or discounts.
- Compliance: Customers must meet all specified requirements and deadlines to be eligible for a promotion.
13.3 Vouchers and Coupons
- Exclusivity: Vouchers are issued to a specific Customer and are non-transferable.
- Redemption: * Vouchers have no cash value and cannot be redeemed for cash.
- Only one voucher may be used per transaction; vouchers cannot be stacked.
- You must accurately enter or select the voucher code at the time of the transaction.
- First-Time Offers: “First-time customer” vouchers apply strictly to a user’s first transaction. If the first transaction does not meet the voucher’s criteria, the voucher is forfeited and cannot be applied to subsequent transactions.
- Usage: Once a voucher is redeemed, it is considered “used.” This action is irreversible, even if the transaction is later modified or cancelled for any reason.
- Abuse: O&F reserves the right to cancel or invalidate any voucher if we suspect misuse, fraudulent activity, or a violation of these Terms.
14. Payment Terms
14.1 Payment Methods
We accept a variety of payment methods, which may vary depending on the service type, your account status, and whether you are transacting online or in-branch.
- Accepted Methods: Bank Transfer, PayID, PayTo, Credit/Debit Card, EFTPOS, and Cash.
- Restrictions: We do not accept cash deposits made directly into our bank account at a bank branch.
14.2 Card Payments (Online)
- Processing: Online card payments are processed instantly via a secure gateway.
- Surcharges: A surcharge applies to all credit and debit card transactions. Details are displayed on your receipt.
- Security: You may be required to enter a 3D Secure verification code from your bank. Never share this code with anyone, including O&F staff or Affiliates.
14.3 Processing and Instructions
- Cleared Funds: Transactions will only be processed once we receive cleared funds. O&F assumes no responsibility for funds until they are successfully received by us.
- Account Ownership: Payments must originate from a bank account or card held in the same name as the O&F account holder (individual or business). Third-party payments will be declined and the transaction cancelled.
- Timeframes:
- Online/Booking: Payment must be made within 24 hours of submission.
- In-Branch: EFTPOS and Cash payments must be completed immediately.
- Failure to meet these timeframes may result in the automatic cancellation of your transaction.
15. Foreign Currency Exchange (Cash)
15.1 Best-Rate Guarantee
O&F may offer to match or beat a competitor’s price at our discretion. This policy generally applies to in-branch transactions under the following conditions:
- The competitor must have a physical retail store.
- The quote must be current, verifiable, and available for the same currency and amount at that exact time.
- The competitor must have the physical stock available for immediate payout.
- The price must be transparent, with no hidden commissions or fees.
- Note: O&F reserves the right to decline a rate-match request without providing a specific reason.
15.2 Identification Requirements
- Thresholds: While some small-value cash exchanges may not require full ID, O&F reserves the right to request valid Identification documents for any transaction, regardless of the amount.
- Data Collection: If ID is not provided for a low-value exchange, we will still collect basic contact information. Please note that transactions completed without ID may not be retrievable in our system for future reference.
15.3 Acceptable Banknotes
- We only purchase foreign banknotes that are currently in circulation and listed on our official buying list.
- Condition: Notes must be in reasonable condition. We may refuse notes that are torn, stapled, excessively worn, holed, or heat-damaged.
- Denominations: We may restrict the acceptance of specific denominations for certain currencies. Please check with branch staff for current restrictions.
15.4 Change of Mind & Cancellations
- In-Branch & Booking: Due to constant fluctuations in market rates, we do not accept “change of mind” cancellations once an exchange is complete. If you wish to reverse a transaction, you must initiate a new transaction to buy or sell the currency back at the current prevailing rate.
- Online Transactions: * You may request a cancellation only before your order status changes to “Your currency order is being processed.”
- A $15.00 cancellation fee applies.
- Funds from a cancelled transaction cannot be transferred to a new order; a new payment must be initiated for any subsequent transaction.
16. Online Foreign Currency Orders
16.1 Ordering and Identification
- Service Scope: You may use our online platform to order foreign currency cash for collection at O&F or a designated Australia Post Office.
- Mandatory ID: In accordance with Australian law, we require valid identification documents for all online transactions, regardless of the amount.
- Confirmation: By paying the Total Amount, you agree that all transaction details—including the amount, rate, and collection location—are correct. You do not have an automatic right to change the amount or currency once the order is submitted.
16.2 Transaction Limits and History
- Limits: Minimum and maximum transaction limits apply. These vary based on the collection method and location. Detailed limits are available in our website FAQ or by contacting our branches.
- Accessing Records:
- Registered Users: You can view your full transaction history by logging into your account.
- Guest Users: As guest sessions may time out, you should refer to your confirmation email or contact us for transaction inquiries.
16.3 Collection and Timing
- Processing Time: Collection and delivery times depend on your chosen Payment Method, currency availability, and the specific collection location.
- Date Guarantees: We cannot guarantee your preferred pickup date if you change your Payment Method after submission.
- Rate Adjustments: If you fail to meet our payment requirements within the specified timeframe, O&F reserves the right to adjust the Exchange Rate without prior consent.
17. Online Payments and Surcharges
17.1 Payment Methods and Procedures
- Accepted Methods: We accept Bank Transfer, PayID, Credit/Debit Cards, and EFTPOS. Direct cash deposits into our bank accounts are strictly prohibited.
- Account Ownership: All payments must originate from an account or card held in the name of the individual or business registered with O&F. Third-party payments will be declined.
- Timeframe: Online payments must be made within 24 hours of order submission. O&F is not responsible for funds until they are received as cleared funds in our account.
17.2 Card Security
- Instant Processing: Card payments are processed via a secure gateway. You may be prompted for a verification code from your bank; never share this code with anyone, including O&F staff.
- Surcharges: Credit and debit card surcharges apply and are non-refundable unless O&F is at fault.
18. Online Delivery and Cancellation Fees
18.1 Australia Post Delivery
- Service Fees: A fee of $10.00 – $20.00 applies to orders delivered to Australia Post Office locations. The exact fee will be disclosed at the time of your transaction.
18.2 Cancellation and Admin Fees
If you cancel an online order, the following deductions will apply to your refund:
- Standard Cancellation: A $15.00 fee applies if you cancel before your order status changes to “Your currency order is being processed.”
- Uncollected Orders: This $15.00 fee also applies to orders that are not collected within the designated timeframe.
- Excess Fund Refunds: An administration fee of $5.00 applies if you request a refund for extra funds paid to us without the intent to use our services (this fee is waived if the balance is used as credit for a future transaction).
- Third-Party Charges: Any external costs O&F incurs as a result of your cancellation request will be deducted from your refund.
19. Collection and Delivery Logistics
19.1 Nominated Collection Dates
- Selection: Available collection or delivery dates will be highlighted during the online ordering process. You must select one of these available dates as your nominated collection day.
- Notifications: You will receive email notifications regarding the delivery status of your foreign currency to either an O&F branch or an Australia Post location.
- Amendments: To change your collection date or location, you must contact us immediately. Once an order is marked as “processed,” no further amendments can be made.
- O&F Discretion: We reserve the right to modify collection or delivery periods at our sole discretion.
19.2 Collection Requirements & Security
- Verification: To collect your currency, you must present a valid Australian Driver’s Licence or Passport.
- Name Match: The name on your identification must correspond exactly with the name used for the transaction. If the names do not match and you cannot provide supporting legal documentation for the discrepancy, the transaction will not be paid out.
- Authorisation: We do not allow third-party authorisations. Only the person who placed the order may collect the currency.
- Signatures: You are required to provide a signature at the time of collection.
19.3 Australia Post Specifics
- Redirection Prohibited: You must not redirect your delivery to a Parcel Locker, a different Post Office, or another residential address.
- Liability: O&F is not liable for any unauthorised collections or missing parcels if you redirect a delivery away from your nominated Post Office location.
20. Cancellations, Disputes, and Uncollected Orders
20.1 Exotic Currencies
O&F reserves the right to cancel any transaction involving “exotic” or rare currencies if our suppliers are unable to fulfill the request.
20.2 Dispute Timeframes
- General Online Disputes: If you believe an online transaction was processed incorrectly, you must notify O&F within 24 hours of the transaction completion.
- Cash Counting Errors: Any disputes regarding cash discrepancies for in-branch transactions must be reported within 7 days.
- Good Faith: As with all transactions, if O&F identifies a technical or human error post-transaction, you agree to cooperate in good faith to rectify the balance.
20.3 Uncollected Transactions
If you fail to collect your transaction on your nominated date:
- Reminders: We will attempt to contact you via phone, SMS, or email.
- Automatic Cancellation: If we cannot reach you within two (2) business days after the collection date, the transaction will be cancelled.
- Refunds: Once the currency parcel is returned to our head office, a refund will be processed automatically to your original payment method, minus a $15.00 cancellation fee.
21: Service Terms and Transaction Limits
21.1. In-Store Operations (Physical Branch)
1.1 Availability: Oxford Forex operates a flagship branch located at 133 Oxford Street, Darlinghurst, NSW 2010. This location is open for physical transactions 24 hours a day, 7 days a week, 365 days a year, including all weekends and Australian public holidays. 1.2 Services: Customers may visit the branch in person to both purchase (Buy) foreign currency and liquidate (Sell) foreign currency in exchange for Australian Dollars (AUD). 1.3 Rates: All in-store transactions are processed using real-time exchange rates provided by our on-site specialists at the time of the transaction.
21.2 Online Transactions (E-Commerce)
2.1 Scope of Service: Our online platform is available 24/7 for Currency Purchase (Buy) only. Online “Sell” transactions (exchanging foreign notes for AUD) are not supported via the web interface and must be completed in-store. 2.2 Transaction Limits:

Maximum Order Value: Online orders are capped at a maximum value of $5,000 AUD per transaction.

Card Payment Limit: Orders paid via Credit or Debit card are strictly limited to a maximum value of $2,000 AUD. 2.3 Payment Verification: Oxford Forex reserves the right to request additional identification or verify payment details for any online order to comply with AUSTRAC obligations.
21.3 Order Fulfilment and Delivery
3.1 Collection (In-Store Pickup): Customers may choose to collect their online orders from our 24/7 flagship store. You must present the valid government-issued photo ID used during the online checkout process and the physical card used for payment (if applicable) at the time of collection. 3.2 Secure Post (Delivery): For customers opting for delivery, orders will be dispatched via a Secure Postal Service. Oxford Forex is responsible for the currency until it is marked as “Delivered” by the carrier. Delivery times are subject to third-party postal schedules and may vary by location. 3.3 Processing Times: While the platform is available 24/7, orders requiring manual verification or postal dispatch will be processed during standard business administration hours.
